If you do not wish to be bound by these Terms and Conditions, You should avoid having access or use this Service. If You utilize the Service in a manner inconsistent with these Terms and Conditions, CASHBK LLP may terminate your access, block your future access and/or seek such additional relief as the circumstances of your misuse. CASHBK LLP may modify the Terms and Conditions at any time, and such modification shall be effective immediately upon posting of the modified Terms and Conditions. You agree to review the Terms and Conditions periodically to be aware of such modifications and your continued access or use of the Service shall be deemed your conclusive acceptance of the modified Terms and Conditions.

When you use the CAASHbkks Application or send e-mails to us, you are communicating with us electronically. You thereby consent to receive communications from us electronically. We will communicate with you by e-mail, SMS and push notification on mobile. For contractual purposes, you consent to receive communications from us electronically and you agree that all agreements, notices, disclosures and other communications that we provide to you electronically satisfy any legal requirement that such communications be in writing.
All content included in or made available through Application, such as graphics, logos, page headers, button icons, scripts, and service names are registered or unregistered trademarks or trade names of CASHBK LLP, its affiliates or its Partners in India. The CASHBK LLP trademarks and/or trade names may only be associated with its services and may not be used in connection with any other products and/ or services, in any manner that is likely to cause confusion among customers, or in any manner that disparages or discredits App. All other trademarks not owned by CASHBK LLP or its Partners or its vendors that appear on CAASHbkk Application are the property of their respective owners, who may or may not be affiliated with, connected to, or sponsored by CASHBK LLP, its vendors or its Partners. All content included on this App, such as text, graphics, logos, button icons, images, audio clips, digital downloads, data compilations, and software, is the exclusive property of CASHBK LLP, its Partners or its vendors and such content is protected under the Intellectual Property laws enforce in India.
Subject to your compliance with these Conditions of Use and your payment of applicable fees for pro plan as per Subscription Plans, for the business partner and free of cost for the customers, CASHBK LLP or its content providers grant you a limited, non-exclusive, non-transferable, non-sub-licensable license to access and make personal and non-commercial use of their services. You may print and download (page caching) or portions of material from the different areas of the Service solely for your own non-commercial use. This license does not include any resale or commercial use of any Service, or its contents; any collection and use of any listings, descriptions, or prices; any derivative use of any Service or its contents; any downloading or copying of account information for the benefit of another merchant; or any use of data mining, robots, or similar data gathering and extraction tools. All rights not expressly granted to you in these Conditions of Use are reserved and retained by CASHBK LLP, or its licensors, suppliers, publishers, rights holders, or other content providers. No Service, nor any part of any CAASHbkk Application, may be reproduced, duplicated, copied, sold, resold, replicated or otherwise exploited for any commercial purpose without express written consent of CASHBK LLP. You may not frame or utilize framing techniques to enclose any trademark, logo, or other proprietary information (including images, text, page layout, or form) of CAASHbkk Application, without express written consent. You may not use any Meta tags or any other "hidden text" utilizing CAASHbkk Application name or trademarks without the express written consent of CASHBK LLP. You may not misuse the Services. You may use the Services only as permitted by law. The licenses granted by CASHBK LLP Shall terminate if you do not comply with these Terms and Conditions of Use.
If you use this CAASHbkk Application, you are responsible for maintaining the confidentiality of your account and password and for restricting access to your Device. Furthermore, you are responsible for any and all activities that occur under your account or password. You authorize CASHBK LLP, to assume that any person using the CAASHbkk Application with your password and user name either is you or is authorized to act for you. You agree to notify us immediately of any unauthorized use of your account or any other breach of security. CASHBK LLP shall not be liable for any loss that you may incur as a result of someone else using your password or account either with or without your knowledge. However, you could be held liable for losses incurred by CASHBK LLP or another party due to someone else using your account or password. CASHBK LLP, does not sell services for children, but it sells them to adults, who can purchase with an API or Wallet. If you are under the age of 18, you may use CAASHbkk Application only with involvement of a parent or guardian. CAASHbkk Application and its Partners reserve the right to refuse service, terminate accounts, remove or edit content, or cancel orders in their sole discretion.
CASHBK LLP together with its Partners attempts to be as accurate as possible. However, CASHBK LLP does not warrant that the product descriptions and logos, photographs, images provided by the Businesses or other content of this CAASHbkk Application is accurate, complete, reliable, current, or error-free and it shall be sole responsibility of the Businesses. It shall be the Businesses responsibility to ensure merchantability and fitness for a particular purpose of the products and services they offer through the CAASHbkk Application and also that the products and services offered by the Businesses would neither be illegal nor against decency, morality and Public Policy prevailing in India.
Customers or Businesses may post reviews, ratings, comments, photos, and other content and communications, and submit suggestions, ideas, comments, questions, or other information, so long as the content is not illegal, obscene, threatening, defamatory, invasive of privacy, infringing of intellectual property rights, or otherwise injurious to third parties or objectionable and does not consist of or contain software viruses, political campaigning, commercial solicitation, chain letters, mass mailings, or any form of "spam." You may not use a false e-mail address; impersonate any person or entity, or other content. CASHBK LLP reserves the right (but is not obligated) to remove or edit such content, but does not regularly review posted content.
If you do post content or submit material, and unless we indicate otherwise, you grant CASHBK LLP a nonexclusive, royalty-free, perpetual, irrevocable, and fully sub-licensable right to use, reproduce, modify, adapt, publish, translate, create derivative works from, distribute, and display such content throughout the world in any media. You grant CASHBK LLP and sub licensees the right to use the name that you submit in connection with such content, if they choose. You represent and warrant that you own or otherwise control all of the rights to the content that you post; that the content is accurate; that use of the content you supply does not violate this policy and will not cause injury to any person or entity; and that you will indemnify CASHBK LLP for all claims resulting from content you supply. CASHBK LLP has the right but not the obligation to monitor and edit or remove any activity or content. This licence includes our use of your name, company name, and franchise name, as applicable, and any of the trademarks, service marks, trade names, logos, and personal and commercial images you provide.
By sending us Submissions and/or posting Contributions through any part of the Services or making Contributions accessible through the Services by linking your account through the Services to any of your social networking accounts, you
You are solely responsible for your Submissions and/or Contributions and you expressly agree to reimburse us for any and all losses that we may suffer because of your breach of (a) this section, (b) any third party’s intellectual property rights, or (c) applicable law.
Although we have no obligation to monitor any Contributions, we shall have the right to remove or edit any Contributions at any time without notice if in our reasonable opinion we consider such Contributions harmful or in breach of these Legal Terms. If we remove or edit any such Contributions, we may also suspend or disable your account and report you to the authorities.
CASHBK LLP respects the intellectual property of others. If you believe that your work has been copied in a way that constitutes copyright infringement, please report on the address prescribed below.
You may be required to register to use the Services. You agree to keep your password confidential and will be responsible for all use of your account and password. We reserve the right to remove, reclaim, or change a username you select if we determine, in our sole discretion, that such username is inappropriate, obscene, or otherwise objectionable.
You may not access or use the Services for any purpose other than that for which we make the Services available. The Services may not be used in connection with any commercial endeavours except those that are specifically endorsed or approved by us.
All items purchased from the Businesses via CAASHbkk Application which is only a loyalty program Application and does not deal in any sale or purchase or delivery which are made pursuant to a delivery contract between the Businesses through various posts on timeline and customers receive cashback from the Businesses.
CAASHbkk Application offers a paid Service the pro plan. For the pro plan they can choose either monthly, quarterly, half-yearly or annual subscription plan. The pro plan includes customer loyalty system, city wide five post every month on timeline for gross marketing, three business category selection, complete data analytics section and other services. If there are more than 1 branch the shopkeeper or company will be eligible for activation of cross branches loyalty system, city wide five post every month on timeline for each branch account for gross marketing, one business category selection, complete data analytics section for each branch differently and other services.
The shopkeepers or companies registering for the CAASHbkk’s pro plan of the Application have to pay monthly, quarterly, half-yearly or annual subscription fee as per Subscription Plans and it will be automatically deducted through the via Paytm gateway. If they do not pay the subscription, automatically some services will be stopped.
If shopkeepers or companies are subscribing to CAASHbkk Pro plans, they can sign up for either a monthly, quarterly, half-yearly or annual subscription. Their subscription will renew on a monthly, quarterly, half-yearly or annual basis as applicable. They can cancel the subscription at any time. If they cancel the subscription, they will not receive a refund or credit for any amounts that have already been billed.
We may offer 30 day-free trial to new shopkeepers or companies who register with the Services
CAASHbkk reserves the right to change its prices at any time. If you are on a subscription plan, changes to pricing will not apply until your next renewal.
All Shopkeeper Partners shall accept redemption from CAASHbkk Application users or Customers through their reward (Universal and Exclusive) redemption process (reward shall be treated as 1 Point = 1 Rs. Private Cashback).
Sign up for the customers is free of cost.
There shall not be any refunds/returns affected via the Application. The Businesses Partners, shopkeepers and companies after subscription have to exhaust the services provided by CAASHbkk Application for the whole plan and there shall be no cancellation or refund of the Subscription amount once paid to CASHBK LLP.
CASHBK LLP and all information, content, materials, products (including software) and services included on or otherwise made available to you through this CAASHbkk Application are provided by CASHBK LLP or its Partners on an "as is" and "as available" basis, unless otherwise specified in writing. CASHBK LLP and its Partners make no representations or warranties of any kind, express or implied, as to the operation of this CAASHbkk Application or the information, content, materials, products (including software) or services included on or otherwise made available to you through this CAASHbkk Application, unless otherwise specified in writing. You expressly agree that your use of this CAASHbkk Application is at your sole risk.
To the full extent permissible by applicable law, CASHBK LLP and its Partners disclaim all warranties, express or implied, including, but not limited to, implied warranties of merchantability and fitness for a particular purpose. CASHBK LLP and its Partners do not warrant that this CAASHbkk Application; information, content, materials, products (including software) or services included on or otherwise made available to you through this CAASHbkk Application; their servers; or e-mail sent from the CAASHbkk Application are free of viruses, or other harmful components. CASHBK LLP and its Partners will not be liable for any damages of any kind arising from the use of this CAASHbkk Application or from any information, content, materials, products (including software) or services included on or otherwise made available to you through this CAASHbkk Application, including, but not limited to direct, indirect, incidental, punitive, and consequential damages, unless otherwise specified in writing.
(a) Violate any applicable local, provincial, state, national or international law, statute, ordinance, rule or regulation;
(b) Interfere with or disrupt computer networks connected to Application;
(c) Impersonate any other person or entity, or make any misrepresentation as to your employment by or affiliation with any other person or entity;
(d) Forge headers or in any manner manipulate identifiers in order to disguise the origin of any user information;
(e) Interfere with or disrupt the use of App by any other user, nor "stalk", threaten, or in any manner harass another user;
(f) Use CAASHbkk Application in such a manner as to gain unauthorized entry or access to the computer systems of others;
(g) Reproduce, copy, modify, sell, store, distribute or otherwise exploit for any commercial purposes Application, or any component thereof (including, but not limited to any materials or information accessible through CAASHbkk Application);
(h) Use content from the CAASHbkk Application for derivative works with a commercial motive without prior written consent of the CASHBK LLP.
(i) Use any device, software or routine to interfere or attempt to interfere with the proper working of CAASHbkk Application; or
(j) Impose an unreasonable or disproportionately large load on CAASHbkk Application infrastructure.
(k) Spam CAASHbkk Application by indiscriminately and repeatedly posting content or forwarding mail that may be considered spam etc.
(l) Access data not intended for you or log into server or account that you are not authorized to access;
(m) Constitute an act of reverse engineering, decompiling, disassembling, deciphering or otherwise attempting to derive the source code for the CAASHbkk Application or any related technology or any part thereof.
(n) Engage in "framing," "mirroring," or otherwise simulating the appearance or function of the CAASHbkk Application.
(o) Attempt to probe, scan or test the vulnerability of a system or network;
(p) Use automated means to crawl and/or scrape content from CAASHbkk Application and to manually scrape content from this Application;
(q) The CAASHbkk Application uses technological means to exclude Robots etc. from crawling it and scraping content. You undertake not to circumvent these methods.
(r) Access the CAASHbkk Application except through the interfaces expressly provided by this Application;
(s) Attempt or breach security or authentication measures without proper authorization;
(t) Providing deeplinks into CAASHbkk Application without prior permission of CASHBK LLP is prohibited. Extracting data from us using any automated process such as spiders, crawlers etc. or through any manual process for a purpose which has not been authorised in writing.
(u) Upload, post, email, transmit or otherwise make available either directly or indirectly, any unsolicited bulk e-mail or unsolicited commercial e-mail.
(v) users shall under no circumstance sublicense, assign, or transfer the License, and any attempt at such sublicense, assignment or transfer is void.
(w) Constitute hosting, modifying, uploading, posting, transmitting, publishing, or distributing any material or information:
These Terms shall be governed, interpreted, and construed in accordance with the laws of India, without regard to the conflict of law provisions and for resolution of any dispute arising out of your use of the Services or in relation to these Terms. Notwithstanding the foregoing, you agree that (i) CASHBK LLP has the right to bring any proceedings before any court/forum of competent jurisdiction and you irrevocably submit to the jurisdiction of such courts or forum; and (ii) any proceeding brought by you shall be exclusively before the courts in Jamnagar, India.
You agree that any legal action, dispute or proceeding between CASHBK LLP and you for any purpose concerning the Terms and Conditions or in relation to your visit to the CAASHbkk Application or the products you purchase through the CAASHbkk Application or the parties' obligation hereunder shall be governed by the Arbitration & Conciliation Act, 1996 enforceable in India. Any cause of action or claim you may have with respect to the Services must be commenced within one (01) year after the claim or cause of action arises or such claim or cause of action is barred.
Please review all other policies, such as our privacy policy posted on this Application. These policies also govern your visit to the CAASHbkk Application. CASHBK LLP reserve the right to make changes to our CAASHbkk Application, policies, and to the Terms and Conditions at any time. If any of these Terms and Conditions shall be deemed unlawful, void, or for any reason unenforceable, then that provision shall be deemed severable from these Terms and Conditions and shall not affect the validity and enforceability of any remaining provisions.
If there is a conflict or contradiction between the terms and conditions in CAASHbkk Application and any other relevant terms and conditions, policies or notices, the other relevant terms and conditions, policies or notices which relate specifically to a particular section or module in CAASHbkk Application shall prevail in respect of your use of the relevant section or module of the web Application.
